After more than 8 years of buying stuff on the forums, looks like I have had my first transaction go bad. I have bought stuff here on ebay, audiogon, videogon, photography forums and I have found that people are mostly trust worthy. Out here in this forum, its been a great experience and I would regard this more of an anomaly.

I wanted to put this post to warn others of dealing with Yaphet.

I bought a moome ext-hd v2 from the buy and sell forums here [[http://www.curtpalme.com/forum/viewtopic.php?p=271079&highlight=#271079]. I have had numerous PM exchanges where he has said that he has mailed it out, but strangely it keeps going back to him. Last week was to be his 4th attempt at this. Since then no replies for him or a tracking number. I am willing to give people the benefit of doubt- sh*t happens, but this time its past that.

Specifics-
I paypaled the money on Oct 7th and since then we cant seem to get the card

++Messages from Yaphet ++
Oct 28th- "Hello
I know it did not get to you because my girlfriend said that it came to the house this morning wile I was at work. ... As soon as I get home I will UPS it to you...You will get your card ASAP."

Oct 23rd- "Hello
The card got here this morning, its being held at the office. Im off to send it off to you."

Oct 21st- "Hello
I tracked it down. The problem was the post office did not put on the new lable with your corect address ... So it was sent back out to the same address. ... Once more I am sorry for all this."

Oct 20th-"Sorry did not see this message. Yes I sent it out Saturday and it should have arrived Tuesday. I think I have a tracking # at home. ... Sorry about this, should be there tho. I will take care of all this to night when I get home."

Oct 20- "... tomorrow I will go to the post office and find out the problem. If they lost your shipment I will refund your money. ..."

Oct 15th- "Hello
I regret to tell tou that I made a address mistake when sending out your MOOME card and I am sorry. ... Once more I am sorry for this. Have a great weekend."

Oct 9th- "Hello
Just wanted to let you know that it has bean shipped, thanks"

Looks like he's tried to sell a few things over the past 6 months. I wonder how those transactions went.
The emails do read a little weird and I've never heard of someone getting something sent back on 3 occasions. Once maybe.....

The fact that he mailed in the earlier occasions and seemed sincere was why I still believed in him and that the item would show up at my door.

But in retrospect, his disinclination to share a tracking number and getting it wrong 4 times was too much to take. if I had this problem as a seller, I would overnite it with atracking number at the very least.

if those spelling errors are from his emails sent to you, then he could very well be telling the truth, he just cant spell worth a damn to get your address right Confused

At this point I would file a claim with paypal, you only have 30 days to do it.

Yep, file with Paypal, you're covered for a couple more days.

Has anyone had good transactions with him? I like to give everyone the benefit of the doubt, but non delivery or scammers are certainly not welcome here. I assume that he checks the forum, so with a post like this, let's hope he responds, or I have no problems deleting him.

Last visit Oct 28th, so he's not a regular visitor. Definitely file a claim with PP or your CC if you paid with a card. You'll have better response if the latter. I think PP allows 45 days to file a dispute, unless the rules have changed.

yep filed a claim with Paypal yesterday- lets see how good they really are when it comes to dealing with fraudulent scenarios. From my point of view, all the evidence is there for Paypal to take the decision.

Hi,
PayPal will take care of you. This is not the first time PayPal had a problem with Yaphet. I don't want to get in to the details of my deal. But it all worked out in the end. Curt what about a three strike rule and the Member would be unable to post in the Buy/Sell forum?

Good idea, we'd have to ask Kal how hard that would be to implement. Anyone can simply sign up under another user name (ie Gary M), so it's easy to work around it, but the regulars here will sure remember a post like this, so the best thing is to post (legitimate) issues with other forum members.

If the seller can't provide Paypal with a tracking number, you'll get your money back.

I'm for a one strike rule: If someone screws someone else out of something, they're out of here.

Trying to automate something like that isn't really possible as you're always going to want to review it.

We do have a "GOOD TRADER THREAD" in the BUY/SELL forum that people can search on if they want. See: https://www.curtpalme.com/forum_archived/viewtopic.php@t=6125.html

Information on bad transactions should go there too.

Kal

I never received a reply from Yaphet- however Paypal did settle in my favor. I got refunded the entire amount about 30 days after I filed the claim- very pleasantly surprised by Paypal!

Glad it all worked out in the end!

People like to slam PayPal but I really like them for the protection it offers. They don't refuse reasonable offers.

Yaphet's account here has now been removed given that:

(1) This is not the first time people have complained about sales going "bad" with him.
(2) He did not refund the buyer like he said he would.
(3) He stopped communicating with the forum and the buyer.

We don't need the same crap to repeat itself 6 months later...

So Yaphet ended up in the Gary Murrell list.Smile

I agree Kal about Paypal. I had a problem with an ebay seller this summer and he almost swindled me out of the money. Fortunately, Paypal resolved it and I got my money back.

I love ebay for that. If you go to some site somewhere and buy something and have an issue, it's your word against theirs.

If you buy off eBay, you've got someone to moderate in the middle.

Whenever a store also sells on eBay too, I always go there first.

I wanted to add one more thing to this. Is there anyway you could post the city that he lives in, Art? That way people could be on alert if he posts here or somewhere else.
